2. Scope of the Privacy Policy

This Privacy Policy defines the principles for processing the personal data of persons who:

visit the HOUM online store,
place orders,
create a customer account,
contact the store,
subscribe to the newsletter,
use forms available on the Store,
interact with HOUM advertisements,
use the website where analytical and advertising technologies operate, including Google, Meta, and TikTok.

We process data primarily in accordance with the 🍪 GDPR and applicable Polish law, including the Electronic Communications Law.

3. What data we may process

Depending on how you use the Store, we may process, in particular:

Order data:
first and last name, email address, phone number, delivery address, billing address, company details, NIP, information regarding the order, and the chosen method of delivery and payment.

Customer account data:
first and last name, email address, data saved in the profile, order history, and information related to the use of the account.

Contact data:
first name, last name, email address, phone number, and other information voluntarily provided in the message.

Newsletter data:
primarily the email address and information regarding the consent provided and activity related to sent messages.

Technical data and website usage data:
IP address, cookie and device identifiers, information about the device, operating system and browser, entry source, visited subpages, products, user activity, and events such as adding a product to the cart, starting the purchasing process, or making a purchase.

In the case of advertising systems, the data may also include pseudonymous identifiers used to measure the effectiveness of advertisements, create audience groups, and conduct remarketing.

Regarding the newsletter and electronic marketing, we require prior consent. Art. 398 of the applicable Electronic Communications Law requires consent for sending commercial information and direct marketing using electronic means of communication.

5. Newsletter

The user may voluntarily subscribe to the HOUM newsletter.

The newsletter may include, among others:

information about new products,
information about promotions,
materials regarding HOUM products,
inspiration and content related to animals and interior design,
information about special offers.

Subscribing to the newsletter is voluntary.

The user may withdraw consent at any time by using the unsubscribe link found in the newsletter message or by contacting us at info@houm.pet.

Withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.

6. Cookies and similar technologies

The Store uses cookies and similar technologies, such as pixels, tags, device identifiers, and analytical scripts.

Cookies may be used to:

ensure the proper functioning of the Store,
remember the contents of the cart,
maintain user sessions,
increase security,
remember settings,
conduct statistics,
analyze the use of the Store,
measure the effectiveness of advertisements,
conduct remarketing,

In accordance with Art. 399 of the Electronic Communications Law, storing information on a user's device or accessing it generally requires prior notification of the user and obtaining their consent. An exception applies to technologies necessary for data transmission or for providing a service explicitly requested by the user.

These are essential for the operation of the Store, e.g., shopping cart handling, the purchasing process, security, and session maintenance. They do not require consent to the extent that they are necessary to provide the service requested by the user.

The Store may use Meta Pixel technology and other Meta tools related to advertisements on Facebook and Instagram.

These technologies may enable, among others:

measuring the effectiveness of advertisements,
determining whether a user made a purchase after clicking an advertisement,
creating advertising audience groups,
conducting remarketing,
optimizing advertising campaigns.

For users in the European region, Meta services are generally provided by Meta Platforms Ireland Limited.

We activate Meta technologies requiring optional cookies after obtaining the user's consent.

11. TikTok Pixel

The Store may use TikTok Pixel and other TikTok advertising technologies.

These may be used to:

measure conversions,
analyze advertising effectiveness,
conduct remarketing,
create audience groups,
optimize campaigns.

Transmitted data may include information about the device, internet identifiers, and information about events performed in the Store.

In the European Economic Area, one of the TikTok entities responsible for data processing is TikTok Technology Limited, based in Ireland.

TikTok Pixel is activated after obtaining the appropriate consent.

12. Shopify Platform

The HOUM store operates on the Shopify platform.

In connection with operating the Store, customer data may be processed by Shopify to the extent necessary to provide the store infrastructure, order processing, customer accounts, and other platform features.

For merchants operating in Europe, the main Shopify entity is currently Shopify International Limited, based in Ireland. Shopify also indicates that in situations where it processes customer data on behalf of a merchant, it acts as a data processor.

Shopify also uses its own companies and subcontractors providing, among others, hosting, infrastructure, and payment services.

13. Data recipients

Data may be shared with entities supporting us in operating the Store, in particular:

Shopify and its subcontractors,
payment operators,
banks,
courier and logistics companies,
accounting service providers,
hosting and IT service providers,
newsletter system providers,
customer service system providers,
Google,
Meta,
TikTok,
providers of analytical and advertising tools,
entities providing legal, tax, or accounting services,
public authorities, when the obligation to provide data results from the law.

Entities processing data on our behalf receive access to data only to the extent necessary to provide their services.

14. Transfer of data outside the European Economic Area

Some providers of technologies used by the Store operate globally. Consequently, data may also be processed outside the European Economic Area, in particular in the United States or Canada.

In such cases, data transfer takes place using mechanisms provided by the GDPR, such as:

European Commission decisions confirming an adequate level of protection,
standard contractual clauses of the European Commission,
other legally permissible data transfer safeguards.

Shopify indicates that despite storing some European store data in Europe, international data processing may occur, and it uses, among others, appropriate agreements and standard contractual clauses in this regard.

15. Data retention period

We store data for the period necessary to achieve the purpose for which it was collected.

In particular:

Data related to orders – for the duration of the contract, and then for the period required by tax and accounting regulations and the limitation period for any claims.

Data related to the customer account – for the period of account ownership, and then for the period necessary to secure potential claims or fulfill legal obligations.

Data related to contact – for the period necessary to handle the matter, and then for the period necessary to secure potential claims.

Newsletter data – until the withdrawal of consent or the termination of the newsletter, although we may retain information about previously granted consent to the extent necessary to prove its legality.

Data processed based on marketing consent or cookies – until the withdrawal of consent or for the period resulting from the duration of the given cookie or technology.

16. User rights

The data subject may have the right to:

access to the data,
obtain a copy of the data,
rectify the data,
delete the data,
restrict processing,
transfer the data,
object to data processing based on a legitimate interest,
withdraw consent,
lodge a complaint with a supervisory authority.

17. Withdrawal of consent

If data is processed based on consent, the user may withdraw it at any time.

This applies in particular to:

marketing cookies,
Meta technologies,
Google technologies,
TikTok technologies.

Withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.

18. Profiling and advertising

In connection with the use of advertising tools, we may conduct limited user profiling.

It may involve, among others, analyzing:

visited products,
activity in the Store,
cart content,
purchases made,
entry source,
reactions to advertisements.

This information may be used to create audience groups and present advertisements tailored to user interests.

We do not make decisions toward customers that produce significant legal effects solely based on automated data processing.

19. Voluntary nature of providing data

Providing data is generally voluntary.

Failure to provide the required data may prevent the completion of a given action.

In the case of contact with us or activity on our profiles, user data may be processed both by HOUM and by the operator of the given service in accordance with the rules applicable on that platform.
